VaderVPN - Terms of Service

1. Acceptance of Terms

By installing VaderVPN software, purchasing or redeeming a token, or using any VaderVPN service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. The Service

VaderVPN provides virtual private networking, encrypted tunneling, DNS-filtering, and related privacy tools. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted uptime, speeds, compatibility with specific networks, or immunity from blocking, network interference, or service outages.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement in your jurisdiction to use the Service.

4. User Responsibilities

You agree not to use the Service for activities that violate applicable law, including but not limited to harassment, unauthorized access to computer systems, malware distribution, child exploitation, copyright infringement, fraud, or other unlawful conduct.

5. No-Logging Policy

VaderVPN does not collect or log browsing activity, DNS queries, connection destinations, or traffic contents.

Non-identifying operational metrics, such as aggregate server load, bandwidth utilization, and error statistics, may be collected temporarily to maintain and improve the Service. These metrics do not include browsing activity, DNS queries, traffic contents, or connection destinations and are purged periodically.

6. Payments and Tokens

Purchases grant access to the amount of bandwidth associated with the purchased token. Tokens expire according to the expiration period displayed at the time of purchase.

Except where required by applicable law, purchases are non-refundable.

Users are responsible for paying applicable taxes and maintaining accurate payment information where required.

7. Token Responsibility

VaderVPN cannot recover lost, deleted, transferred, or otherwise inaccessible tokens. Users are solely responsible for securely storing their tokens.

8. License to Use the Software

Subject to these Terms, VaderVPN grants you a limited, revocable, non-exclusive license to use VaderVPN applications solely for accessing the Service.

9. Service Modifications

We may modify, suspend, restrict, or discontinue all or part of the Service at any time, with or without notice.

10. Disclaimer of Warranties

The Service is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, VaderVPN's total liability arising out of or relating to the Service shall not exceed the greater of:

(a) twenty-five U.S. dollars (US $25), or

(b) the amount you paid to VaderVPN during the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold VaderVPN, its owners, employees, contractors, and affiliates harmless from claims, liabilities, damages, losses, and expenses arising from your misuse of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles.

14. Termination

We may suspend or terminate access to the Service for violations of these Terms, legal requirements, fraud, abuse of the Service, or failure to satisfy payment obligations.

15. Force Majeure

VaderVPN shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, acts of government, war, labor disputes, internet outages, or failures of third-party providers.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
